Terms & Conditions for Falcon Food & Spirits Ltd
As detailed throughout the Terms and Conditions and other sections of the website, the following words and phrases have the following meanings:
United Kingdom refers to England, Wales, Scotland, Northern Ireland and the Channel Islands.
Us, we, ourselves, our refers to Falcon Food & Spirits Ltd.
You, users, customers, individuals refer to browsers of the website and those who place orders with us.
T&C, T&C’s refers to the Terms and Conditions as set out in this document.
You must read the T&Cs carefully. By placing an order with us you have read, understood and agree to the T&Cs as set out. Should you not agree with the T&C’s in their entirety you should not place an order with us.
These T&Cs do not affect your statutory rights.
3.0 Our Products
Falcon Food & Spirits Ltd is a distributor and supplier of goods and products from external companies, both from within and outside the United Kingdom.
We have been granted the rights to promote the products on the website and other forms of social media (twitter, Facebook) from the main suppliers and importers.
Alcoholic products that are promoted and sold on our website are subject to age requirements specified by law. We are not permitted by law to supply these products to individuals who do not satisfy these requirements, and if you are underage, you should not attempt to purchase these products from our website.
By placing an order with us you confirm that you are 18 years and older and permit consumption of the alcoholic beverages only to those over the age of 18 years.
You will go through the check-out process in order to purchase one or more products from our website. You will be required to provide the necessary information needed to fully complete the purchase, including and not limited to the following:
Address details (and delivery address details should this be different to the billing account address);
Contact details, in the form of email addresses, telephone numbers;
Age and date or birth
Once an order is placed with us, you will receive an email to confirm the order. This does not constitute acceptance of payment or the order until the order has been dispatched.
Once the order has been dispatched, you will not be able to cancel the order. You shall receive an email from us to confirm dispatch of the order.
All prices are in sterling and include VAT, exclusive of postage and packaging.
If an error is discovered, we shall contact you as soon as possible.
Delivery of the order will be via courier service or Royal Mail dependant on the size and quantity of the order. The order will specify the amount charged for delivery, if included in the total cost.
Free delivery only applies to orders over £150.00 (excluding delivery charges). The minimum order value may be subject to change at Falcon Food & Spirits Ltd discretion.
Depending on the products ordered, there may be separate delivery charges for each. This will be highlighted in the pre-order page to ensure that you agree to the charges before submitting the order for processing.
The order will be sent to the address specified at the time of check out on the website. If you require delivery of the order to be made at an alternative address, you will provide the address details and any other relevant information (i.e., areas to leave the package, if requested)
Falcon Food & Spirits Ltd and our couriers reserve the right to ask for age-identification upon delivery of goods. Forms of acceptable proof are:
- Driving License
- PASS cards
If the age of the person(s) accepting the goods is doubted by us and/or our couriers, we reserve the right to withhold delivery of the products.
6.0 Returned items:
In the event that you are not fully satisfied with the purchase from us, you are required to contact us at email@example.com quoting the order reference number, name, address and contact details, in addition to specifying the reasons for returning the items.
All items should be returned in the original packaging at your own expense, to the address listed on the homepage. Please note that once the products have been opened/ consumed or the tamper tags have been broken, a refund cannot be made unless there has been a fault with the product.
7.0 Cancellation of Orders:
Should you wish to cancel the order with us, you should do so by sending us an email to: firstname.lastname@example.org quoting the order reference number, name, address and contact number. You will receive an email to confirm cancellation of the order within 2 working days.
As per the Distance Selling Directive, you may cancel your order within 7 working days of delivery. You must confirm this in writing to email@example.com.
Unless agreed otherwise in writing, Falcon Food & Spirits Ltd’s maximum liability to you arising by reason of or in connection with the supply of the products to you shall be limited to the amount you paid with regard to the products in question (payment amount).
Online purchases from the website to be made using Paypal.
We maintain the right to provide links to other websites from www.falconfoodandspirits.co.uk although we do not accept any liability (wholly or partly) at the point you leave our website for any losses you incur. No waiver by us shall be construed as a waiver of any rights or remedies, or any subsequent breach of any provision of these Conditions of Sale.
We abide by the Responsible Drinking guidelines and accept no liability or responsibility for consumers who exceed the Government recommended daily/ weekly alcoholic unit consumption for any injuries incurred or losses sustained following irresponsible consumption of our products.
We reserve the right to amend the T&Cs without prior notice. As they are prone to amendments without notice, we encourage you to review the T&Cs prior to submitting a purchase on the website.
11.0 Force Majeure:
Falcon Food & Spirits Ltd will have no liability for any delay or failure to deliver the products to the extent that such delay or failure to deliver arises from causes beyond reasonable control of Falcon Food & Spirits Ltd including, but not limited to storm, fire, floods, acts of God, malicious damage, acts or regulations of any governmental or supranational authority, war, riot, strike, lock out and industrial disputes or default of our suppliers or importers.
12.0 Governing Law:
These Terms and Conditions shall be exclusively governed by and construed in accordance with the Laws of England and you irrevocably submit to the exclusive jurisdiction of the Courts of England.
